Stott & Co Ltd agrees to perform the work in a competent manner according to modern, recognised arboricultural practices and in compliance with the specification and description of works on our quotation/estimate.
A non-refundable deposit of 50% is payable on acceptance of the quote with full payment of the invoice payable within 7 days of completion of the contract.
Non payment within 7 days may result in referral of invoices to a debt collection agency. The authorised signatory (you) accepts that all costs relating to debt collection are paid by them in addition to the Stott & Co invoiced amount.
Amendments to the contract will be made in writing.
We hope you don't have any as we're one of the best arborist companies in Auckland, however if these arise, complaints must be raised in writing to email@example.com within 4 days from the date of invoice (the sooner the better so we can assist you with any issue).
Tree preservation orders and conservation areas
The trees concerned in the contract may be in a conservation area or be protected by a district plan. Responsibility for all permission obtained from relevant authority will remain the responsibility of the authorised signatory or owner unless Stott and Co is requested to do so in this contract.
Stott & Co Ltd. accepts no responsibility for any tree work commissioned without prior approval from Council if the tree is of significance or otherwise.
Private covenants and boundaries
Investigation of private covenants and boundaries shall be the responsibility of the authorised signatory/owner and no liability shall attach to Stott & Co Ltd. for a breach of any such covenant or boundary.
If the trees are on a boundary line or shared fence line the authorised signatory/owner must obtain written approval from the neighbouring properties prior to the work commencing.
Stott & Co Ltd. will not be held liable for any grievances or claims for tree work that is undertaken and we highly recommend communicating with and advising all immediate neighbours of the date the tree work will be carried out.
Unless a plan showing the exact location of underground pipes, wires or cables is provided to Stott & Co Ltd by the authorised signatory/owner of the land (or their agent) prior to the formation of the contract, Stott & Co Ltd shall be under no liability for any damage caused as a result of work performed to such pipes, wires or cables, or for any damage to property resulting therefrom. The owner of the land (or their agent) shall be solely liable for any such damage.
Power lines or telephone cables
Any charge for the removal of power lines or telephone cables into the property is the responsibility of the owners.
Completion of contract
Stott & Co Ltd. will not be liable for damages or otherwise because of non-performance of a contract arising on account of adverse weather conditions, strikes, lockouts, war and civil commotion. Further, we retain the right in such circumstances to cancel the contract in whole or in part.
Completion dates shall be contingent upon weather conditions.
Expiry of quotation
The quotation expires after 30 days from the issue date. The work will need to be re-quoted unless otherwise agreed to in writing.
Following the acceptance of the quote and agreement on a date for the work to be completed, cancellations must be made at least 3 working days prior.
If a cancellation is made after that period, Stott & Co Ltd. has the right to charge a cancellation fee of 20% in addition to the non-refundable 50% deposit.
Quotations for felling are based on the assumption of trees being free from metal, stone or other hidden obstructions. In the event of a tree being impossible to fell in the quoted way using standard techniques, Stott & Co Ltd. reserves the right to requote accordingly.
Stott & Co Ltd. will check the trees, stumps and surrounding area as much as possible during our initial site visit. However, there is a chance that hidden obstructions such as nails, old fences, etc. that are not visible until the work is underway. Stott & Co Ltd. reserves the right to alter the price of the job accordingly as this may mean additional hours/equipment.
Stump grinding involves the removal of the tree stump to a depth of 150mm, but does not include the removal of lateral root or stump chippings unless specified otherwise.
The grindings will be used to backfill the hole and will be spread around the surrounding area where possible.
If there is significant debris under or near the stump we will remove as much of the stump using our grinder as we safely and practically can.
The contract price is based on the site conditions existing at the time of the preparation of the quote/estimate remaining unchanged.
All work carried out by Stott & Co Ltd. is covered by $2,000,000 Third Party and Public Liability Insurance for damage to persons or property that may result in the implementation of the contract.
An insurance certificate can be supplied if requested by the client.
